Hello hope you can give me some advice. I attended a jobcentre plus interview today and was told that i am only able to have my nat ins contributions paid and will not receive any further help as my partner is in employment. The problem is he has had to accept a job away from the area so is presently paying for accommodation for himself plus the costs for our present home. I did get contributory job seekers allowance over 2yrs ago when the company i worked for went out of business and i was only getting bits of temping work. Since then i put any money i had into starting up my own small business but the past 12 mths have been very quiet and the business is not sustainable, im not earning anything from it at all. I have worked consistently for over 30yrs and would obviously prefer not to be in this position but it just seems a bit unfair that i am penalised because my partner has a job! I would appreciate hearing from anybody who has been in this position or can offer any advice. Many thanks.

you need to look at the contributions you have paid in the tax years 08/09 and 09/10, that is the tax years the contribution based JSA is based - class 2 conts do not count in the award of benefitskintbint x

Then the DWP assess you on IBJSA and like you said your husband works and earns enough to keep you both.*SIGH*

When assessing income based they dont take into account debts and costs you have to pay out of your partners wages. Just the actual amount they earn.
So really there isnt alot you can do apart from try find a job0 -
