Can I return item for refund (to America)?

I bought a necklace from America and I am ashamed to say it was an impulse buy. It arrived yesterday and when I put it on I have to use the last link on the extender it is still tight. Now I am aware that I should have been more careful and checked everything before I bought as it does state the measurements on the website is.

I am just wondering if you have any rights to return it for a refund. I know we have laws in this coutry re distance selling but not sure if they stand in my case.

Any help greatfully received :o

    Why dont you email them to ask.. Your right about the DSR rights not being enforced due to it being the states. But contact them and see what they say

    Why dont you email the company and say what you said here, And see what they say regarding a return - refund.

    Then post here if your having a consumer problem. Because right now your not.

    Sorry shoulld have said I did email them and they have responded by saying that they cant issue a refund as it is company policy, which is why I asked about any rights I may have.

    Even if you have rights (which I doubt in this case) can you fund going to Court in the USA to try and enforce them? Would they exchange it for another item?

    No they have refused an exchange as well, looks like I am stuck with it then :(

    Only other thing you can do is dispute the transaction, Say its not up to what it was advertised. Once you get funds back send the necklace back to them along with a letter explaining what you disputed.

    Cant go wrong.
