need help

Hi can someone help me please.

Im on the sick at the moment, ive been on it for 5 months.

Can i leave my job and my partner claim for me has hes on JSA.

I really cant go back to work at the moment, im suffering from depression and have for year, but for some reason this job is making it worse.

Im willing to look for a new job, ive always worked never been on benefits, so i need some help.

    All those that know the answers are probably at work, be patient, someone will be along soon to help.

    I don't know the answer sorry but I know if you leave a job you cannot claim JSA for a certain number of weeks.

    If you were on your own my advice would be to look at the possibility of ESA and obviously seek work that won't make you feel this way... you would probably have to seek medical help too if not already to ensure you have medical backing for your situation. But I'm completely out of my depth when it comes to joint claims/having a partner and hopefully someone else will be able to advise. If they aren't then maybe the CAB or similar could help advise.... take a look at the whole picture of you and your partner... the options and what would happen if he were to get a job... and indeed you lose/drop yours.

    my advice on what you have said would be for you to claim ESA in your own right if you are not fit for work or if you go down the route of a joint claim for JSA they will take into account the reasons you left your last employment but you will be expected to look for work, fit for work and be available for work , however there are other things to take into account before giving any meaningful advice like
    Do you have children?
    what type of JSA is your partner on -contribution based or Income Based?
    have you worked for the last two full tax years and paid contributions 08/09 and 09/10?

    My partner on contributions jsa, I have no children, yes I've worked them tax years.

    If I had my notice in and I have a sick note off my doctor what will I be entailed to.

    What everyone is saying is DONT hand your notice in, if you do you will be sanctioned. Wait until your company ends your employment and you will be able to make a joint claim straightawat. Resiging would be foolish.

    the adjudication officer will look at the reasons why you handed your notice in and take them into account when deciding on JSA, the same may be done if you are paid off depending on the circumstances so without being an adjudication officer in full receipt of the facts no one will be able to tell you if you will be sanctioned either for leaving or your employment being terminated. if you are not fit for work you should consider claiming Contribution Based ESA as you say your doctor will give you a certificate.
