    The limitation period applies to the council's claim against the OP separately to the MIB's claim against the OP. The MIB would only have become liable recently if payment was made in July this year - hence the limitation period applying to their claim against the OP is, as I understand it, 6 years from July 2011.

    Ahh, the way I read the OP was the accident happened back in 2005, I assume the council got judgement against the OP some time later and the MIB paid it as they are obliged to do. At this stage the debt passed to the MIB (with a new 6 year limit?) and they have now (july 2011) issued proceedings to recover.

    Having said that, I do agree that discussing limitation isn't particularly useful as either way the court case is not statute barred, on the other hand I also think that allowing Quentin's erroneous (I believe) statement about limitations to go unquestioned is even less useful as others might rely on it.
