I think you do, as they will be evidence of the bailiffs mistake0 -
As I understand it, the evidence is the bailiff has admitted taking the car and is still in possession of it. It was taken in the presence of neighbours, and later police officers who saw a big truck in the car park lifting my car off the ground then driving away. Neighbours thought I had it repossessed. I have the Officers names and my MP's secretary will ask to see their incident books.0

Most not all baliffs are pure scum and thugs."Man invented language to satisfy his deep need to complain."

Update, My car reappeared as if by magic.
Neighbours said a truck turned up and lifted it back into its bay and left. As reported by another neighbour, it has a damaged nearside wing from when someone was putting the wheel clamp on. I'll write a statement and ask the neighbour for a siggy.
We are going away in the morning so I will have the bodyshop fetch my car for repairs on our return.
I spoke to the Child Support Agency and they do not accept liability for costs. They are currently just under £3000 and increases by £76 a day for my rental car plus the repairs to my own car. My MPs office says the CSA is liable because there is no contract and the bailiff company is contracted to the Child Support Agency. Apparently the CSA can reclaim it by making an official Form 4 complaint to the court, and the bailiff pays the CSA from his deposit or insurance. So not sure why the CSA are trying to weedle out of it.
The CSA also said the blame lies with childs mother because she provided the information about my car. I cannot litigate because the CSA is unable to disclose the childs mothers name and address because of data protection act. The CSA even suggested contacting police, but it was explained the police have already predetermined this matter on three previous occasions to be a civil matter.
As recommended by CAG forum, I recorded the call.
We are away for the weekend from early tomorrow, so we can pick this up next week.0 -
The childs mother may have unwittingly thought the car belong to her ex to be fair, but the CSA shouldn't have just taken her word for it, surely the bailiffs/csa have access to the registered keepers record and can actually check?
Although I know this is not conclusive: owner isn't necessarily the registered keeper: but it should have flagged up a warning.
The police are wriggling out of the original theft of your car by hiding behind 'civil' as an excuse.
Glad to hear you have the car back and your MP is supportive.Unless specifically stated all posts by me are my own considered opinion.
If you don't like my opinion feel free to respond with your own.0 -
this is highly unusual as the CSA usually get evidence of the legal owner of the vehicle via the DVLA - you need to find out who is responsible for the failure of obtaining this info - the CSa or the bailiffs. The CSA cannot instruct a baliff to seize specific goods, so I would have thought that the bailiff should have checked the legal owner before taking the car.0
