CSA bailiffs have taken my car! How do I complain?

  • The flat downstairs doesnt have curtains, but being on a 1st floor, looking through the windows isnt easy.

    What should I be recording? sorry Ive never dealt with these people before.

    I havnt asked the bailiff or anyone else to pay for the recovery service to North london, I intended to ask my MP about my costs once they are known, isnt this the right route?

    Taking photos, what should I be taking?

    I didn't know I could look up online for the court name, they printed a form for me to complete, I looked at the consumer group , what am I looking for? the bailiff said they don't return seized cars, I have to collect it,

    as i said the bailiff is playing you for a fool yes they do return seized cars especially when they they have illegally removed it

    The consumer group is much the same as this but they have a dedicated poster who specialises in bailiffs debt

    I suggest you join and post your question there before you do anything else

    you take photos of the empty property

    How many people do you know who would leave there car outside there previous address when they move (none) this gives the bailiff less Chance of calming prima facie (at first site)

    you should be recording all calls you make to the bailiff and the bailiff company
    to provide proof of any conversation you have with them as i said they have a selective memory

    A Form 4 complaint is a very serious matter and the bailiff could have his certificate removed therefore no job the Judge who heres the complaint wont rely on he said she said they want proof this can be in the form of a transcript taken from a recording

  • I dont have access to the empty property, im not sure how taking inside photos helps me. The bailiff mentioned about taking photos of the car parked in downstairs flat

    I'll see if my mobile can make recorded calls.

    The bailiff said something the debtor failed to notify the CSA he changed address, and the bailiff acted on information the car belonged to him so he should be responsible for my costs(is that true??). I acknowledge him borrowing my car for the school run but that shoudnt be grounds its his car. He has since moved to Nova Scotia so I cant claim from him.

    I am getting conflicting signals as to who is responsible for costs, which is why I'm leaving it to meeting with MP.

    CSA blames bailiffs
    Bailiffs blames debtor
    Debtor is unavailable
    so bailiffs blames me because I parked in downstairs flat parking bay.

    MP office secretary suggests they go find out who gave the bailiff the address and the registration of my car, before making a claim.

    The CSA are ultimately liable for the bailiff and his unlawful seizure so I would be inclined to send them an invoice for your costs including the ongoing car hire and other reasonable costs involved with the recovery, send it as a letter before action giving them 14 days to pay after which youy will initiate an action in County court with themselves and the bailiff as co-defendant. It may be worth a go as may pestering your MP , but check out the CAG forums as now you have posted there, you should get some specific advice

    you take photo's from the outside

    The bailiff and CSA are fully responsible for the removal of your car a DVLA and HP check should have been done before removal

    ask the key holder if there is any other letters from the bailiff
    in particular a notice of seizure listing your car

  • Theres lots of letters, and the property management company for our block sent them on or returned them.

    I have a seizure letter, no enevelope and another note with big red Final Notice on it, thats how I got the bailiffs name and mobile.

    there should have been a notice of seizure of goods and inventory (form 7)
    and a removal notice (form 9) hand delivered so no return address

    they look something like this

    And if you make a form 4 complaint and the bailiff cant provide copy's of these forms if asked by the judge he is in deep shxx

  • Yes they were on the doormat but arent addressed to me, do I need them? The bailiffs mobile number was on a red Final Notice document.
