child support from non biological father

Hi myself and I have been looking after our grandchild for the last 18 months, this was due to abusive parents (physically & mentally) towards her. At first we asked for help with some child support payments from them but they were not willing, so I said well we will contact CSA for these payments. My daughter then contacted them herself and after 6 months we started to receive CSA from her. A seperate case was also opened by the CSA against her father. This was soon closed as my daughter said that he was not the biological father! ( our granddaughter is now 17yrs old) and he is on the birth certificate!
So then our dughter contacted CSA to try and reduce the payment (£40) that she makes to us each week as her daughter was on an apprenticeship course and receiving a small income!
This then led to CSA re opening the case against her so called father, as they stated he should pay for the care and upkeep of his duaghter. This has been going on over this past year and for us last week to be given a schedule of payments he should be making for the care of his daughter, to today being told the case is now closed - which seems to be on my daughters say so!!!
Please can someone help us so we can get the correct information. We have no relationship with my daughter or husband since we were protecting my granddaughter from their abuse.
My daughter is very clever with words and seems to have talked her way out of her husband paying any maintenece.
Is this correct, that we have now found out he is not the biological father (from my daughters say so!!)
Are we entitled to receive CSA from him. We are nearing retirement age and do not have all the means to support a young teenager.

Are you sure that the CSA opened a case against her father? If so, did he challenge his paternity? Was a DNA test ever done?If you've have not made a mistake, you've made nothing0

It would be very unfair for him to have to pay for a child that is not his if yr daughter is telling the truth re parentage.
So yr daughters husband is not yr grandaughters biological dad??......who has yr daughter been trying to claim CM off??....sorry just a bit confused!!
Personally I don't see why yr daughter can't help to support her daughter, if you opened the CSA case against yr daughter she cannot close it!0 -
are you claiming child benefit and tax credits for the child? if you are on a low income, you might also be entitled to healthy start vouchers so it's worth looking into.
You can claim maintenance, through the CSA, from the person named on the birth certificate as the father. It would be up to him to dispute paternity and a DNA test would be carried out to prove or disprove the situation. I would personally pursue a claim and let the 'father' deal with it, rather than deal with what your daughter is saying.0 -
yes he is on the birth certificate he put it on himself at the age of two and is still stating he is her father the child is unaware of him not being her biological father she still has contact with her family he has bought her up as his own does not want her to no otherwise but csa at first said they were unhappy with the case as he bought her up and is on her birth certificate but now at 17 years old does not want to help her financially just still being horrible to her but can say what he wants he says as he is her dad is it against the law to put name on birth certificate how does it stand for my grandaughter with official forms ie passport is this all fraudulent thankyou0

Do you mean he literally put it on himself, i.e wrote on the birth certificate himself?? If so, there might be a question of legality! If he is proved not to be the girls' biological father by DNA testing, then he has no obligation to pay CSA.0

and..yr daughter was claiming CM through CSA for daughter from 'father' and you were claiming CM through CSA for daughter from mother????
How can CSA claim from both parents for one child?

Why...........the daughter/mother has a right to support her child too.
Sounds like a very mixed up situation and one you have been trying to help yr grandaughter with as best as possible.....well done to you for getting yr grandaughter away from 'that' kind of homelife.

Granny told mummy she wanted child support, mummy said no, granny said I'm phoning CSA.
Mummy phoned CSA herself and started the CSA ball rolling, mummy has to pay child suppport to granny for the grandchild.
Seperate case against daddy was opened, but mummy phoned CSA and told them daddy wasn't actually the bio daddy even though "he put himself on the BC" as the father. Case closed....

Last week CSA send payment schedule to granny for daddy's liability, then mummy phones CSA and again say's nope he ain't the bio daddy and case closed again.
Granny has no relationship with kids' mother or father as granny was protecting kid from the abuse mummy and daddy were dishing out.
Now Granny believes mummy is clever with words and the CSA have closed the child support liability for daddy.
Although no one really knows if daddy is the bio daddy or not!*SIGH*

That's how I saw it as well, still a bit confused re birth cert though!!!!! I didn't realise you could put your name on the BC so long after the event!!! 0 -

I've no personal experience of the CSA but, judging from previous threads on here, if the father is on the birth certificate then unless he takes a DNA test and proves that he isn't the father, he is accepted by them as the father.
