because cab will be able to tell if the fact that no contract between me and wonga for such an amount exists wether i am in my rights to tell em no, and if they cant tell me, they will tell me who can. as no one here really seems to know.

CAB will be able to tell you no such thing without knowing the facts, and the first thing they will ask you is whether you have contacted wonga to find out why there was a discrepancy in the amount you received.
Even with that information I very much doubt whether CAB will pass comment on the legality of your contract with Wonga.

A mistake does not invalidate a contract and you would be required to contact the company and give them a chance to rectify the error. If you contacted them and they refused to satisfy the full terms of the contract then you would have a case to cancel the contract but you haven't done this.
There's no sense crying over every mistake.

That is not what the OP wants to hear.

You really need to start growing up.

Lets play by your rules, you have no contract, it's all null and void (it isn't but lets humour you for a moment).

Give Wonga back the £117 they have deposited into your account... oh no! you can't can you? We know that as your bills are already bouncing as being unpaid.

You have nothing to repay Wonga but I suppose as you have no contract, you can keep the money for yourself and not give it back.

Grow up! Ring Wonga and ask what is going on.

They may or may not give you the extra £33 but of course, we already know that is going to be swallowed up by the bill which hasn't been paid.

What hope have you of repaying this Wonga loan even when it is all sorted out?

Now consider Wonga will strike you from their "good borrower" books and reject any further applications you make.

Fast forward one Month... what are you going to do with no money and bill to pay?

For goodness sake just ring Wonga & sort it out.

    There is a contract, regardless.

You will have to pay back what you owe.

You won't get out of it.

Call Wonga and either return the money you borrowed, or get them to explain why they only transferred £117.
  • Not meaning to just repeat the words of everyone else. But if i had borrowed money from Wonga (thankfully i've never needed to) and they put the wrong amount in to my account, the very first thing i would do would be to call them and find out exactly whats going on. If you consider that you are also struggling to pay bills at the moment, then posting a question about it all on MSE would be at the bottom of my priorities right now. =/

Some people will try every twist and turn to weedle out of paying back what they have borrowed.
I used to think that good grammar is important, but now I know that good wine is importanter.
  • Hang on a flying minute - do you mean to imply that since they sent you the wrong amount, you dont have to pay back the £117?

    You can't be serious.
