hi there i borrowed some money of wonga and agreed to payback the amount + interest. But looking in my bank they havent deposited the full amount agreed, but when i look on there website they are still set to charge me for the full amount of which was agreed.
Does this void the contract as they have not fullfilled there part?

Well it really depends on why they haven't paid in the full amount you expected. Is it a processing charge or a faster payment charge that they have deducted?

If they haven't lent you the amount that you expected and its not charges then you repayment should also be lower - i.e you should only have to pay back what you did receive plus the interest - but you will definitely need to pay back something, it could not possibly 'void' your contract so that nothing is repayable.

How much did you want to borrow? How much was paid into your account?

i requested a loan for 150 and they deposited 117, now it might not be much but the difference in interest is over 50 pounds. and they have not charged me for quick payment or any other sort of charges before, my point is that no contract actually exists between us for such an amount to be lent to me.

You need to ask them why the amount you received was lower and ask them to recalculate your repayments based on the amount you did receive.

  • The £117 would be your loan of £150 less charge for set up etc.
I dont see how you think they have voided their contract with you, are you just hoping not to pay ?
  • If you log into your account on their website what does it say?

yes i am hoping to not pay, and no the 117 is not the 150 less charges for set up, as i said before on previous transactions i have allways recieved the full amount agreed, please read the posts before posting.

In theory if you were due £150 and they've only paid £117 you could sue them for the remainder, either way you're still bound to make the repayments and fees you have to repay and when you have to repay them.

I don't think there is any way a contract can become 'void' unless one of you has taken the other to court and had a judge determine that.

All of the above costs money of course :)

Why would they do something like that? They may find that there is a perfectly good reason. and it would spoil the attempted fraud
