My holiday company cancelled my hol!!!

bit of advice please....the short version is this:

Holiday booked last year.All ok.I phoned them last Tuesday to query something re camp site(we we due to be on hol in the south of France 4 days later...Saturday just gone)

They called me back to say that head office in Holland had received a cancellation last Oct from some one in the local office who I booked with!This guy is no longer working there and no one knows why it happened.long and short is that I had no holiday with only 4 days to go...and it was me who contacted them to discover this..if i hadn't then we would have driven all the way there to be told "soreee zere iz no booking wiz us."That would have been fun after a 15 hour drive.

So I managed to get a full refund and they have paid me for the cost of the eurotunnel...they have only offered £150 on top as compensation! I have refused obviously.My point being that any hol we try and book now will cost me more than my camping hol.they offered a one bed apartment as a replacement.we were due to be in a 3 bed caravan with 2 teenagers! have trawled holiday sites and there are no camping holidays available.campsites get full really fast in France.so i costed 3* and above in europe (flying) and it was about £3000...£1000 more than my camping hol.

I have put all this to SELECT CAMP...(the delightful company we booked with) to no avail.They have offered any more, so I have sent a letter to them confirming that we are in a state of deadlock and that I will be seeking legal advice with the ombudsman for compensation.......my question is...is the ombudsman that right move or should i just go straight to small claims?

    I am no expert on the legalities (I'm sure someone who is will post soon), and I can understand your frustration and disappointment that your cherished holiday is not going to happen - I am going on hol on Saturday, and if I found out it was cancelled through no fault of my own, I too would be fuming :eek:

    Having said all that, as an objective observer, I am thinking that you have had all your costs refunded, plus an extra £150 compensation. This seems to me like they have fulfilled all their obligations if you have accepted the £150?

    Presumably, you have still got your Eurotunnel reservation - have you costed out travelling across like you would have done and staying in a B&B rather than the flying options you have looked at? I realise it is short notice and many will be booked up, but worth a try perhaps? ;)

    Sorry, can't offer advice but would like to know what the outcome could be. I feel for you, being left in the lurch with such a short amount of time to go. I'd be pressing them for a holiday as close to what you originally booked. They should be bending over backwards to fit you in somewhere.
    There's a storm coming, Mr Johnson. You and your friends better batten down the hatches, because when it hits, you're all gonna wonder how you ever thought you could live so large and leave so little for the rest of us.

    many thanks for your reply.I haven't accepted the £150.I know what you mean that maybe legally they have done 'everything' they can but I just think that I deserve more!

    what do you exactly deserve compensation for?
    Is EVERY campsite fully booked? What dates and area are you looking for?

    'i deserve compensation' is a term that always makes me cringe

    unless it's something completely warranted, such as physical harm caused by negligence of course

    Loss of enjoyment.
    This is a valid reason to sue, putting a value on it is the hard part, the travel agency say £150 you say different.
    If you can think of a figure a judge would agree with then you could win.

    To be honest when I see people seeking compensation it does make me cringe too , but I am that cross , frustrated , and fed up at having my holiday ruined by no fault of mine that I am going to try my hardest to get something to 'compensate' for the fact that I have been left without a holiday.

    'loss of enjoyment' is indeed a term I can use.thanks for that :p

    Yeah, every site with the facilities from our original holiday are full.
