PPI Time bar

Apologies but this is the first time I have posted - so bear with me!!!

In June 2009 I submitted a complaint for missold PPI to Ulster Bank credit card using the template letters on this website. At that time my complaint was rejected as out of time (the PPI started in 2001),in fact the bank said they were unable to investigate ad also that I should have known earlier and raised my concerns at an earlier stage. Foolishly I believed the bank and let it drop. However following the recent ruling I decided to resubmit the complaint however the bank have replied that this is a duplicate claim and as they previously "carried out a thorough investigation" and closed the last one they are are under no obligation to reopen the case.

I was wondering if anyone has tried to get a closed case reopened and if there is any point in my going to the Ombudsman - I am really angry because they are just refusing to investigate and then telling lies that they have already investigated.

Any help would be appreciated.

    The recent ruling had nothing to do with past complaints. So, in that respect, it didnt change the situation.
    I decided to resubmit the complaint however the bank have replied that this is a duplicate claim and as they previously "carried out a thorough investigation" and closed the last one they are are under no obligation to reopen the case.

    That is the correct response.

    You get 6 months from the complaint response to take it to the FOS. If you do not do this within 6 months, you would require the permission of the firm to allow the FOS to look at it. If they wont give permission (which is what they are indicating here) then its game over unless you have significant new information which could alter the original decision.

I realise that I am not totally clear on all the details on the PPI issue but I thought that there was a possibility that the banks would look at previously closed cases following the recent ruling. In my case they simply refused to investigate the first claim so I thought that there was no harm in asking again but they have refused again but this time they said that it was because they already carried out an investigation but this is untrue. At the end of the recentl etter they did say "should you remain dissatisfied, you may refer this matter to the FOS for further investigation within 6 months of the date of our final letter". Do you think they are giving me permission to go the FOS?

    id be tempted to give the FOS a call they are very helpful and will guide you on what you should do next. ;)

    The judicial review was about the banks trying to stop looking at certain complaints. Not about consumers going back over old complaints that were rejected. Any review of old complaints is voluntary.

    How you word it, it would suggest they are giving you the option to go to the FOS. However, technically they shouldnt. So, it may well be worth a go.

  • Hi I contacted FOS today who were really helpful. I explained the background and they have advised that I send them a letter and another questionnaie plus the letters from RBS. They have asked me to explain in the letter firstly why I waited until 2009 to lodge the complaint re missold PPI which is basically I didn't know about it until I read about it in the media. Secondly I should explain why I did not refer it to FOS within the 6months from the date of the final decision - at that time and until recently I was dealing with some very difficult issues(no need to go into it now) but basically I had enough to deal with without chasing the banks! Once they have this they will decide if they can proceed any further - so no harm in trying.
