  • I've certainly considered taking it further - to either police or small claims. Will get original rubber cheque back this weekend from my daughter so will try to do something through bank first though. Thanks for all comments and suggestions - keep em coming!!

    However if you sold the tickets at above face value I would be careful before you start trying to sue anyone....

    You'd be surprised. Most have a "cheques" unit that are pretty good at this sort of thing.

    Ultimately, as you can't prove the tickets arrived, then you can't take her to court, as she'd just deny receiving them, and you'd then have to take it up with the post office instead for loss of post, which you can't as you didn't use special delivery.

    I'd perhaps give her one last chance to pay with the threat of reporting her to the police for fraud, and see if she pays.

    Yes, but equally she hasn't returned them anyway.

    As Pinkshoes says you have no proof of delivery. Which small claims court would you think of going to (could be interesting and expensive)?

    I'm sure you morally have a case but you will have to decide whether it really is worth the effort.
  • I did get tickets back and they certainly did look unused.

    I have evidence of her written request for the tickets to be sent to her address, evidence of my sending them, evidence of them being collected late, bounced cheque etc. I'm going to the police first to see what they say - they may not be able to do much but that's where I'm starting anyway!
