Stopped behind a car looked in rear view mirror saw a car comin up fast screech of brakes slams into the back of me lucky i was sat on the brakes it stopped me being shunted so far ahead, his car a right-off and mine too he admitted responsibility cops passing stopped said to exchange details which we did. Been down to the hosp have bad neck and back they say i got trapped tendon in my shoulder got to have phisiotherapy, im a member of the union USDAW they have legal cover, should i call them and make a claim for my injury? I also have legal cover as part of my car insurance (it was in with the price) Also what do i do next i cant call anyone until the morning but do i call the other persons insurance or my own? Im only tpft. Im totally confused as to how to go about this and now have no car

Call the other persons insurers first thing and advise them you will be submitting a claim against their insured. Ask them how they wish you to progress this. They will want to see your vehicle to ensure that it is written off and to establish a value.
In the meantime keep a record (and get receipts) for every trip you have to pay for where you would have used your vehicle.
With regards to the personal injury claim this will take a while to settle as insurers won't be able to gauge what this is worth until recovery is completed in case there are complications or you do not fully recover. As you have legal cover in your policy you could use that and get the lawyers to progress the claim for you.
Finally, you need to ensure that your report it to your insurers for information only, as you have to disclose any accidents to them.0 -
^^ x 2 but also ask the third party company to provide you with a like for like replacement car until it's all sorted out.
As for the injury, PI solicitors firms will be falling over themselves to take your case on. If you use the USDAW legal line they will refer you to their PI solicitors (probably Thompsons) and collect a nice fat referral fee for doing so.
A quick google will find PI solicitor firms that will give you the referral fee if you go to them direct.0 -
Update and another question....
Phoned his insurance first thing this morn told to
email/snail mail them with details, which i did, called my
insurance to say that i had been hit and was just informing
them of this and that i was going through the other persons
insurance, got a call from the other guys insurance they
accept full responsibility and once i get a quote for repairing
my car they will send a courtsey car, garage says its a write off
gonna give me a letter tmrw to send to the insurance ppl.
Phoned usdaw have now got a solicitors ref number should be
calling me in a day or two im not after a big sum of money
just the cost of going to the hospital (i work so i will get the bill
this is what i been told)and any phisiotherapy.
Now im wondering what the next step is i have seen my car or the same model advertised for around 700-800 whats the likely hood this is what they will pay for a replacement? I need a car to get to work and have read if i dont accept the first cheque which is always a low amount they take away the courtsey car0 -
And now im reading that they dont offer a courtesy car if the car is written off
I am going through his insurance i have only told my insurance that it happened but am chasing the rest myself can i ask for a car to be sent so i am able to get to work while im waiting for payment??

As you are the innoccent party in all this you maybe need to get your own claim handler to sort everything for you (as aleady advised above)0

Another question i hope you can help me with.......My question is seeing as it can take months/weeks to get anywhere then what happens if there is an improvement in the injury or a full recovery before any insurance doctors are seen would the case then be dismissed? Im not recovered yet as i said but i just wondered.

When i got nealry wiped out ( in nearly the same way as you) i saw the doctor some 8 months after the accident.
The assesment will be as you are then plus a huge amount of info you will fill in regarding the accident - the doctor makes a estimate of when he thinks you will be fully recovered.0 -

Sent an email to the other persons insurance letter from the garage down the road saying the car wasnt worth repairing, they are now saying they want to take it to an approved garage, (only asked us to see if we knew anyone coz their computer wasnt working properly, they said there was no garages nearby yesterday) to see if it can be repaired, and are sorting me out a hire car from a rental place, asked them about costs and they said just 50 quid deposit which is refundable so long as i dont bump the car. My question is should i allow them to take the car? What if they say its scrap send me a cheque im not happy with and they still have my car?! Also anyone had a hire car paid for by insurers any problems? My otherhalf fixes cars so i'll get him to look the hire car over and make note of any scratches etc before i sign for the car x0
