My GF is having trouble with her student loan from Poland. She have paid a lot of money but it's keep going up and up. It is still more than the original amount she taken out. We need serious help because we want to sort it out before getting married.

If anyone can point out a good lawyer (we can't afford big fees) or help us to write letters(Need legal advice) we will really appreciate it.

Is your girlfriend polish? Can she find a polish website similar to directgov that we have in the UK that explains the student loan system in poland?

I think its unlikely anyone is going to be able to offer specific advice to your situation, so you'll only get very general advice about loans.

Is the loan just with a commercial bank or is it a subsidised central scheme? I suppose you first need to look at why the balance is increasing, presumably the interest being charged is more than her repayments, so as with any loan you need to fully understand the terms & conditions of the loan, check that the interest being charged agrees with the published terms etc. Has she asked for a statement of account so she can see why the balance is increasing. If she is paying it from the UK is she being charged each month because of the way the money is being transferred/paid?

Can you find a Polish student forum that you could try posting for advice on?

Thanks for the advice. I think i need to write for her statement of account because it is passed from private bank to debt collector (Now it's third debt collector.). Every debt collector in past has asked her to pay a big amount after she did they sold the debt to another company. I think they just playing with her debt now because she don't know her rights.
This made me to ask for advice here maybe someone know some cheap polish financial adviser because I can't read her letters in polish.

Not sure how it works in Poland but this is how it worked for me in Hungary (similar system): after finishing uni, you still needed to make a minimal payment which was capped until you found a job. Once you had a job, the repayment went up according to your salary. After I finished uni, I came to England and my parents made the minimal payments on behalf of me (which was about £15 on a £2000 worth student loan). If you missed a payment, you received a fine and the interest started to build up. So even if you regularly paid the minimum but missed one payment, you got a fine and your loan amount seemed higher. I paid off my student loan within a year but this was the system back than. This might be the reason that her loan amount seems bigger even though she made payments. The best is to find the terms and conditions of the loan agreement, if she doesn't have it, than she needs to contact the bank she got the loan it from (in Hungary you got the loan straight from a bank, there was no third party involved).

p.s. one more thing, if the system in Poland shows that she lives in England than all banks need to contact a third party company who act as debt collectors and deal with all kind of correspondence. This does not necessary mean that they bought the loan from the bank, this is just the system there. MY OH is Polish and every conversation we have with the bank there comes through a third party (no loan involved, just keeping a simple bank account) who act on behalf of the bank (such as statements, information about savings, etc).

Thanks for the information. The bank don't know that she lives here. He dad deals with the loan as his name is on loan as well. He did miss few payments and according to him these companies have bought the loan from the bank.

Can someone advice me that how i can ask for statement of account from the start till now to a third debt collector?

I've a Polish friend and AFAIK loan and debt stuff in Poland is much more serious. If you owe you have to pay or else it becomes a serious matter.

Thanks for the information but do you know any solicitor or financial advisor we can take help from.
  • You'd probably need one familiar with Polish law and systems so asking on a UK-based forum is probably not the best idea...
