On Friday I took my car to Toyota for a recall to replace a hybrid water pump.

When I came to collect the car I immediately noticed there was damage to the paintwork, massive scratches down the drivers side doors and back wheel arch.

I went insidee to complain and they produced a visual damage report which had this damage written down on the sheet but the damage was definitely not there when I took it in. Also I was not there when they did the visual report to sign anything to say I agreed with the damage (as there was damage already on the car that I was well aware of) which I thought was the point of a visual report so both parties agree of damage that is there or not.

I still maintained that the damage on the drivers side was not there when I brought it in and they told me that they had not moved the car out of the bay I parked it in to replace the water pump (which seems odd as you would assume work is carried out in the garage not the car park) so their engineers had not caused the damage, but it was after I left I realised the car HAD been moved as I reverse parked it into the bay but had to reverse it out when I left. Also it had been washed and there was no water around the car parking bay, again, meaning the car had indeed been moved.

I really don't know what to do and what my rights are as they are not taking responsibility. Even if they did not cause the damage themselves, it was done while in their care. Surely if I brought their courtesy car back in that state they would be charging me even though they did no visual on that either.

Any help would be appreciated about my rights from now.

Thanks!

You could request the cctv footage to see what happened, most of these garages are well covered so the evidence is there if they don't cover it up. I think you can put in a subject access request for any footage that you or your property is in, as far as I know they must let you view it. Worth a try.
