Hi, help please. I purchased a fishing reel online and on receiving the reel it proved to be unusually noisy when cranked. I contacted the company and they said if I returned it to them with the postage receipt they would check the reel and refund my postage.
They have checked the reel and guess what they can't hear any noise ! They emailed me to say that they will not exchange the reel for a new one of the same model and as a gesture of good will they will not charge me postage to send the reel back to me !!!!
Is an item bought as a sale item still covered by the Sale of Goods Act 1979 or do I have no rights ? Can they just do what they want. They have said that if I can supply a written report from the manufacturer saying the reel has a noise when in use they will refund my postage !!! not exchange the reel.
Thanks

Contact the seller again and inform them that you wish to cancel the contract in accordance with your rights under the distance selling regulations. This is providing not more than 7 working days have elapsed since you received the reel and that the seller made you aware of your right to cancel before you purchased. (If their T&C's didn't advise you of this right then you have 3 months and 7 days to tell them of your desire to cancel).
This link will give you a full guide to the reg's.
