Hi all,
Hoping someone can help or point me in the right direction for information!
My husband has had a barclaycard since 2000 when he was 19. The past couple of years he's had late payments and arrears. Whilst I was trying to sort him out I noticed on his statements he is paying ppi. I questioned him on this and he didn't even know what it was. he is still paying it as he hasn't cancelled it yet - have told him he must do this on Monday.
I think he may have a case to reclaim as he didn't even know he had it.
I opened the questionnaire to fill in and send to Barclays but an awful lot of it asks for jobs and employers at the time. My husband can't remember! He was only 19 and at that time was doing a lot of casual work for a lot of different employers including seasonal work abroad. But he can't remember what he was doing when card was taken out (he can't even remember if card was taken out in a branch or on phone - most likely in a branch though as his bank account was barclays and internet wasn't used so much then.
Anyway - is it likely he has a claim (if so he could pay the card and arrears off) and if so what shall we put for jobs/employemtn on questionnaire??

Just fill in any details you can remember in the final box - this is what we did as we also could not remember certain dates, such as when we originally took out the card.0

The reasons for the information on employment is to establish, whether self employed/ employed. The self employed find it hard to claim for unemployment on a claim for obvious reasons. If employed then some policies say you must be in a permanent employment position otherwise you cant claim under the policy.
So by being seasonel or temporary would mean the policy wasnt suitable at the time it was taken out as he would have trouble making any claim.
You need a copy of the original benefits of the policy document. Your man needs to remember what he was doing at the time. The credit card application will have had his occupation on it.
Then look carefully at the benefits for sickness/unemployment cover especially at the clauses where they will not pay. If the benefits couldnt be paid because of his seasonal/temporary contract then you have a very good reason to claim.
IN essence do your homework first regards whether he would have been eligible to claim when he was 19. If not then state this as your main reason why you are unhappy with the sale. The onus is on the firm to prove that they checked whether the benefits were claimable at the time the policy was taken out. Your job is to say the policy would not have paid him unemployment cover because he wasnt..... and/or the policy would not pay the sickness cover because he wasnt.

We weren't sure if we would have a valid claim as it is shown on his statements (he just never bloody looks at them!) so he did know he had it even if he didn't know he had it (if you see what I mean!).
Interesting about the seasonal employment - he was deifnately in seasonal employment at that time (but he worked for a variety of companies both here and abroad doing ski seasons, adventure activities etc which is what he can't remember)
He's going to phone barclaycard tomorrow (when I badger him enough to do it!) so do you think he could ask them to check their details and send the copy of the tandc over the phone or would he have to send the SAR? - he hasn't got any of the original paperwork (yes it's true I have married the most unorganised character ever!)

Try and get a copy of the terms and conditions of the ppi policy for 2000. Dont worry not having all the details or remembering exactly isnt a problem. It just best to present you case as a fait de complete in saving time. I would get the terms and conditions and list the reasons why your husband was unable to claim as not in premanent work. If he was skiing/dangerous sports at the time then very unlikely ppi would cover accident etc as per last post.
Then fill in the FOS questionairre and send back.
