DLC chased M&S credit card debt

Hi All,
first time posting look forward to your help and sorry for the long post.

Back in i think 1998 i had an M&S store card which they changed over to a credit card with an intial limit of £3500 which was ok and i used it an made my payments. In 2008 i ran into financal difficulties and had you make an arrangement to pay the by this time £6000 as limit rised over time to £6500 i agreed in verbally and in writting £80.00 then from 2009 £100 per month and i have not missed a payment since £100 per month.

Then out of the blue i got a telephone call from a company called DLC who was demanding £4000 very hard line even asking if i could borrow the money from Family etc very unpleasent call, i told them never heard of them i had continued to make agreed payments i will sort with M&S and hung up.

i call M&S and they had recordedi had not paid since the 28th Jan 2011 i told them cheque numbers and cashed dates and they went away can called me back yes i had paid and they had miss allocated my money elsewhere. but i still they have said have to deal with DLC i argued what about charges and interest charged plus DLC charges added to the balance applied wrongly as i had held my end of the agreement.
they are saying no charges applied i dont believe them as i have paid in the 3 years £3000 off £6000 but now debt left £4000.

I dont know what to do next i cant afford more money then the £100pm agreed it they a way out.

    Have M&S not sent you a statement since January 2011? Or have you just not bothered reading them?

    What did they say when you rang to query why they'd stopped sending statements?

    You would probably be better of posting this on the Debt free wannabe board. Someone will be able to point you to template letters you can send to M&S to get all of the transactions that have occurred on the account so you can see what the actual debt is - presumably it will go down once the missing payments have been allocated?
    Don't take calls from the DCA, they will only try to bully you. If you go to DFW again someone will be able to point you in the direction of the correct letters to send.
    I would carry on making payments to M&S, assuming they haven't actually sold on the debt, but would check first to see what was stopping these payments being allocated, incorrect account number or whatever. This shows your intention to clear the debt and would show in your favour should it ever go to court .
  • thanks Wyebird, i am not trying to get out of the Debt it is mine hence i have been paying £100.00 per month for the last 3 years i dont mind it going to court either as i have all banks statements showing paid every month. this is advice i needed judt want to ensure i clear the debt but not have some other company increase it.
