Looks like ex tenants have subletted parking space

    I agree with GM that EA will do nothing - but my reason for suggesting you give owner-of-red-car vendor & EA details is to divert his attention from you onto them...

    Pretty much all been said already, either park another car in the space or secure it with some sunken posts and a chain. If the gentleman damages this to allow access for his car he will probably be committing criminal damage.

    If there is/was a notional agreement to park then one party has lawful means to acquire the name and current address of the previous tenant and that of course will be the police. It sounds to me like a fraud has taken place here. If the owner of the red car were to make an official compliant before the otherwise involvement of the boys in blue to settle a heated argument then they may be more minded to investigate it.

    I agree police should not get involved unless there's a breach, threats etc. If there is, then reporting threats is a good idea in case things escalate.

    Best approach is a physical barrier. Either a padlocked gate/chain whatever across the drive, or a car paked there to stop anyone else.

    Be cautious about clamping - the laws are complex (and changing). You may need to display a warning notice, and it may depend where you are ('island'? What island?) - Eng? Scotland? Research the relevant law before taking this action.

    Although this is enfuriating for you and you clearly have right on your side, look at it from red car man's side for a minute. He probobly rented the space in good faith and may have paid (a year?) in advance. So he, too, is rightly p*ssed off! Trouble is, the villain of the story is the ex-tenant who's vanished, not you OR red car man.

    quite agree and if he had been reasonable in the first place we would have been more sympathetic looks like he has been royally [EMAIL="scr@ed"]done[/EMAIL] over however he should have done his homework and ensured the person renting the space actually owned it But hindsight is a wonderful thing.

    Anyway he has now parked somewhere else for now all we need to do is to ensure he cant get into the driveway before a gate can be put up.

    did you ask him how much rent he was paying? it might be worthwhile to continue the arrangement.....

    When the original tenant's tenancy was terminated, any sublet tenancies they also made were terminated. A sub-tenancy cannot exist when the mesne (silly legal word for higher up the chain) tenancy no longer exists. That's why so many tenants were being dumped out of houses by banks when their landlords were repossessed without proper BTL permission (although the law on that recently changed).

    The man in the red car should be pursuing the old tenants, as they are the party that has deceived him. To avoid becoming a focus for anger this needs to be explained to him. You can refer him to the EA as the only people you know who have the contact address of the old tenants if you want to deflect his anger onto a more 'genuine' source.
