I bought an Apple charger for a MacBook Pro November last year.

It failed, it no longer works. So, I took it back to Bestbuy where I bought it. They checked it out and confirmed it was faulty. So, instead of repairing (they couldn't) or replacing (they had no new chargers in stock), they gave me a credit note.

I, at the time, stated I wanted cash, but I was told they could only give a credit note. I asked twice, and they wouldn't budge. I took the credit note for £59, even though I asked for cash either to the full amount or at a slight loss as the product had had some use.

Am I correct, they shouldn't have given a credit note but cash instead?

I'm sure I was told this when I was taught the Sales of Goods Act when I worked part time for Sevenoaks Sound and Vision.

Technically, yes, they should refund you in cash.
However, as it is over 6 months the onus is on you to prove the fault was present from when you purchased the item, which would require you to get your own independent report. Obviously, if the fault was inherent, BB would have to both refund you, and cover the costs of the test.
You were correct in thinking you may only receive a partial refund due to having some use, but for 8 months, they shouldn't knock much, if any, off.
Go back again with your receipt and credit note and speak to a manager. :)
  • I believe they can offer to refund, replace or repair and, in giving you a credit note, they might imply that you could use the note to buy a new charger (from them of course), thus qualifying the credit note as a replacement or refund - but you might want to check that with someone who has a bit more experience with SOGA.

You had the right to have money refunded in the manner used at time of purchase. Accepting the credit note can be argued against you now seeking cash, however you can argue back that you were offered no alternative at the time and would be returning to speak with a more senior member of staff. Good lck!

Name and shame, this was Best Buy at Merry Hill shopping centre.

Yes, I did ask for a replacement. They had none in stock in the store, so I asked can they order one in, have one on reserve when they do come in or one sent to my home address, and do they have any in their main warehouse. The answer was that they hadn't had any in stock for two months and their main distribution centre had none in stock so they couldn't possibly replace it.

I went to KRCS at Merry Hill Shopping Centre and bought a new one at £60. KRCS said Best Buy are not an Apple Authorised Reseller, which is why Best Buy couldn't get hold of any stock. So, a firm warning to anyone wanting to buy Apple products from them. They only get products in piecemeal from third party wholesalers, or from overstock.

Of note, I then went to speak to a salesman about washing machines. I've seemed to always like Best Buy. Basically, we finally had a large retailer to take on Currys and Comet, but offer decent customer service for a change. The guy seemed fairly honest. Didn't bother much about the 'special offers' or forcing a brand on you like they do at Currys.

However, some things got to me and put me off. Quote:
"We by law have to give a one year guarantee. A lot of our washing machines come with a one year guarantee that includes parts and labour, and a 2 year guarantee that includes parts only. so, we offer over what the law states"

    Ok, wrong there. Then:
"If you decide not to take out our extended warranty (over the two year 'guarantee'), we will not be able to help you with any repair"
Really put me off Best Buy.

Please tell me that the £59 was a typing error...I don't think Macs depreciate quite that fast!

If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.

Not quite sure that is true, they definitely are authorised resellers in the states. Apple even have their own staff in some stores. So I can't see why they wouldn't be in the UK also.

EDIT: They defiantly are authorised sellers, so KRCS was lying. They wouldn't be listed on the Apple website if they were not official: http://www.apple.com/uk/buy/locator/map.html?tySearch=1&viaProduct=2&viaSpecial=-1&strCountry=GBR&lat=51.5&lng=0.4166667&gCountry=GB
