Didn't even have to have an ESA/ ATOS medical

    Cit is obsessed with Atos (in a bad way), only he could make bad on a good outcome like this! Unbelievable!

    Just because there was no medical, does not mean that there was no medical recommendation made by ATOS and no decision made by the DWP. So there will be medical reports that can be requested and cit_k's recommendation that the OP acquire these is actually a good one, so that they can understand why they won their claim.

    They have had a medical assessment, they just dont realise it as they did not have to be present for it.

    They have had a pre-board medical by atos, you can request the details of this (they probably will try to fob you off, as few know it exists even within the dwp) ask for the preboard esa85a report. As well, they may have contacted other medical professionals, and you can ask for a copy of any other medical evidence that was used in the decision (such as letters from your GP/specialist to the DWP) that you may be unaware even exist.

    Jomo is obsessed with ATOS (in a bad way, as they ignore all the multitude of evidence surrounding the issue), and has managed to miss the point completely again.

    Really didn't mean to cause a row or any offence whatsoever.

    Just to clarify I think what probably helped my case is that I included over 5 sides of typed A4 explaining how my condition affects my day to day life and how I felt this impacted on my inability to work.

    I applied everything I wrote to the way the questions were asked so that every question had a kind of 'back up' explanation in my additional details.

    I do this with any benefit form. They are too limiting and narrowly focussed as is. Most times 'touch wood' I have been successful.

    I do realise, and kind of welcome that I have had a 'medical', just didn't have to physically 'go' to one, for which I am very greatful.

    I am incredibly lucky to have a fabulous relationship with my GP, Psychiatrist and after eleven years of trying now how have a bostin Social Worker too. To each of these caregivers I sent a recorded delivery copy of my ESA50 form as I had named them and provided their contact details on my form. This way they could all support what I wrote, and luckily they were all happy to. I have since seen all three and none have been contacted.

    So in conclusion I trust that it's not all over - I know that they will come knoking again, and the whole process will begin again. I'm as mad as a box of sunburned frogs, but I'm not daft - I just trust that I have the right support mechanisms in place at the Mo. I thank my lucky stars for that!
