ATOS report request

Hi

I understand you can request a copy of the ATOS report a few days after your medical has taken place.

(a) Is this correct?

(b) Can someone phone on my behalf as I get very nervous on the phone? My friend has offered to do it for me, as I really get so wound up dealing with phone calls, particularly with people like DWP.

(c) What information would they require in order to forward it on to me, obviously my address but my NI number?

(d) Is there some sort of 'time limit' in which you can request the report? (ie; within two weeks of medical taking place, and then could no longer ask for it, that kind of thing?)

    Just ring up the DWP BDC that deals with you and ask for a copy.

    a) Yes you can request a copy of it from the DWP and indeed would 'need' a copy if there was any attempt to appeal a decision that used it.

    b) Not sure. Someone may be able to answer for sure. But what you could do is get a friend to call and if they say they need you to make the request, perhaps they could hand phone over and you give them that confirmation.. and answer any security questions they may ask.

    c) No information that they won't already have. They'll post a copy to you as long as they're satisfied you've requested it - so they may ask security questions to confirm this and obviously they may ask for things like NI number to get their records up for your case.

    d) The timing. No limits... the reason you might have seen people suggest asking for it a few days after the medical is probably purely so that the DWP has had time to acquire it themselves from ATOS. A request before they've received it should still be honoured but it opens the door to increased complexity to the DWP who have a habit of messing up in admin of ESA.

    yes you can request it

    they may not speak to your friend on your behalf unless you have already listed them in yoru claim as some one who deals with your affairs.

    they ask a series of security questions based on details you have given in your claim.

    Its a simple request and they deal with it daily so dont try to be too nervous. they are jsut the call centre staff so just take the details and put the request for a copy to be sent out.

    You *could* get your friend to phone and say they are you, if they have all your details to hand, but I really dont recommend that.

    one additional thought - a week later from the medical taking place, would they definitely have the report now if I requested it?

    I would say they would almost certainly have it by then since report should be done at time of medical and therefore you'd expect sent to DWP within a working day if they're efficient at ATOS.

    I called for my report 2 days after medical and received it a week after that.

    I was told it can take up to 6 weeks for them to have received and processed it. I received a copy in two weeks.

    The processing it bit is the key as it goes in to a back log, the receiving bit is usually the same or next day.

There's no time limits in getting that report. It's your personal information, and under the DPA, you have a right to see it if you so wish.

    Once that report comes through, read through it carefully, and expect to find faults and contradictions on their part. If you intend to appeal, these faults will need to be highlighted if it gets to the tribunal stage.

    If you have to endure another assessment somewhere down the line, then personally, I'd recommend secretly audio-recording the assessment so that you have a much more 'sure' way of remembering what information it was you gave to them.

    Mobile with a record function in a shirt pocket would do the job, and I look upon this as a way of covering your own back (because Atos certainly won't do it for you).

    Though some would have you believe otherwise, it's not illegal to do this, but don't tell Atos you're doing it. Besides, they don't have to know.

    You could write to the Benefit Delivery Centre that deals with your claim.

    Be sure to quote your National Insurance number and just request a copy of your medical assessment.

    You can request this at any time.
