No company can issue a P45 now for a leaving date in March 2011 even if you left then or not they are not following the payroll/tax rules

I have been onto HMRC about the mistakes on the P45 and they said everything was fine. Just confirmed the advice given on this thread that I needed to fill in a P46 in September.

As for your previous post, if you had read my OP you will have known that the P45 was only just issued and received, I did not receive a P45 in Sep 2009 because I was still on payroll, an error of communication between managers. I only realised this when I received a P60 this year and have been trying to get it sorted with my previous employer since.

Thanks to the kind people on here and HMRC it is all straightened out and I now know it won't be much of an issue.

What? If you left any job in Sept 2009 the P45 is INVAILED as P45's are only good for 6 weeks then you have to sign a P46!!

Of no interest to the OP but in case anyone is reading this post later, a P45 DOES NOT become invalid after 6 weeks. The tax office gives employers instructions on how to use P45s that are years old.
    http://www.hmrc.gov.uk/paye/employees/start-leave/new-employee-p45.htm

About half way down there is a section "Using the right tax code" that has a table showing what code to use for different dates of starting and dates of P45. This table includes instructions for P45 that are dated "before 6 April 2010" for employees who start "on or after 6 April 2011"
It may in some circumstances be better for an employee with an old P45 to "loose" it and follow the P46 route but it is not compulsery.
  • Did you pay tax in 2009, and if so did you get a refund from the tax office?

Thanks, called them today and they did it all on the phone and told me that I will get a full refund. Great money saving advice!!

Well done. I'll have to try referring to HMRC as nice (through slightly gritted teeth) to see if they will do the same for me.
