please please can someone help me????

in 2008 i went with a company called BANKSMART (big mistake i have since found out!!) they said they could get me bank charges back from 2 old bank accounts an after they took out their legal costs etc i would receive £233.66 from one and £21.14 from another, good i thought better than nothing! In the same letters it said i would receive this amount within 21-56 days, never heard a thing!! emailed them got emails back about court proceedings an other legal rubbish. then i receive letters saying i have to pay them £10 for each account for them to receive statements from my bank accounts, i paid them again heard nothing fo years!!!
now i receive 2 letters regarding the 2 separate accoounts saying my claim has been unsuccessful and i owe them£99.00 each for claim being unsuccessful plus VAT of £19.80 totalling £118.80 each!!!! there is no way i can pay this any advice anyone??? i know they've been to court about their t&c's.

    Iamin exactly the same position, just got a letter yesterday for one of the bank accounts they were trying to get fees back from, stating claim unsuccessful and wanting £99 + vat. Not heard from the other account yet but I fully expect to!!

    I have sent banksmart a letter, by recorded delivery, this morning, stating as far as I am concerned the only time I would have to pay fees is if they recovered any money from the bank,which they havent. I referred them to their own terms and conditions which state that the company operates on results and if they get none,you are not obligated to pay the fees. I doubt very much they willtake any notice though, so have also emailed the ombudsman and bbc 1's watchdog program, and I cc'd banksmart in so they can see I am serious. In the letter I sent I have asked banksmart for a breakdown of the fees and a copy of the contract I dont remember signing, when that all arrives (if it does) I will take it all to the c.a.b and take it from there.

    I cant afford to repay this either, and Im worried as since looking on my account online with them I see if I dont pay within 14 days they can issue the full invoice, £168 on one and £275 on the other, and then slap a £150 fee on each for having topursue legal action to obtain their fees. And if I try and cancel, they will slap another £150 on each account!!! I am at my wits end!! I took this on in 2008 on the assumption their fees would come out of any money I got back.

    If anyone knows anything I can do I havent already it would be great, obviouslythey are doing this with a lot of people, everyone email watchdog!!
