Hi there,
I'm wondering if you can advise. I had an offer accepted by a guy who let us go ahead with a structural survey (£850) whilst we were getting our mortgages finalised. He started getting shirty about the time it was taking (4 weeks had elapsed since he accepted our offer) then suddenly revealed he had another person who had had put in an offer and had a valuation survey done that week - before we had our valuation survey done. He gave us a couple of days to get the valutation arranged, which we did, the when my solicitor requested the contract we were advised he had sent it to the other people. I have subsequently found out he had two other people, not just one, who had valuations done, he hadn't declared a race at all.
As well as the structural survey, I paid the valuation fee £290, financial advisor fees £325 and solicitor fees (tbc). Is there ANYTHING I can do to recoup this money? Can I take him to a small claims court?
I have it in writing that he would remove the property from marketing once he had accepted our offer, I sent emails to the EA twice saying he hadn't removed it. He has been so duplicitous I cant believe it.
Any advice would be gratefully received.

No, I think if you have it in writing, there may be a possibility for you to recoup some costs, the vendor or the estate agents should have declared that you were in a contract race, have a word with your solicitors, they will be able to advise you.
