The carpark is directly behind the housing development,w here as previously the work was carried out at the other end of the premises which has a large building and tall trees (apparently they were planted many years ago to stop teh dust heading over towards other housing in the area). The EHO has told them that they must return their operations to that area as this is stated within a planning policy.
Thanks again fortune82
Hmm, they look to be in breech of the planning permission for the building then as well as EHO regs (very similar to my situation).
Give them 2 weeks to comply (regardless of what the EHO say) and then be prepared to report it to the Planning team as an alleged breech of planning (don't assume the teams within the council speak to each other, I guarantee that the Planning Team will have no idea about the breech). Make sure you have documentation to back-up any allegation0 -

Good news. If it doesn't improve pronto, call your local councillor and tell them you want a 'stop notice' served if the EHO hasn't already done this.
Councillors are generally worth their salt and get a rough ride from most of the general public. In my experience they will go out of their way to help in this sort of situation.
Best of luck.0 -

I think you must have had a good one as that was not my experience. Also, dont assume that just 'cause you ask for a STOP order to be placed the EHO will do it as they wont....0 -
thanks for the responses guys, much appreciated. There has not been any work on the site now for two days. We have not had any further contact from the EHO, so I dont know what is happening. It could just be a lull in production, but on the other hand something might actually be happening to resolve the issue0
