Refund-is it me?

Had won two separate auctions with same seller and paid for by pay pal about a month ago. These were services not goods. After the first one, made a complaint and after some e mail communication the seller refused partial refund of first win but agreed to not give second service and give full refund of second win. Am stilll awaiting refund because seller says he has no money in paypal account.
It is my understanding that you dont need money in the account to refund, but just wanted to check with you guys before I go wading in again, for yet another communication with this person. I have tried to be amicable, because I cant go to paypal and raise a dispute there because they are not tangible goods? But its all wearing a bit thin.

They can do a refund & it comes out of their bank account, it will take several days, I can't remember exactly but I think about a week.0
