UKPC Ticket in Cinema Car Park

I managed to earn myself one tonight, parked half on a pavement out of the way, genuinely wasn't obstructing anyone. But that's irrelevant.

Got s ticket for not parking within the bay lines.

Was going to attempt to riggle out of it on a technicality, but are you saying I could save myself the trouble by simply not paying it?

I accept a blatant disregard has no moral grounds to not pay, but still, I don't like paying parking tickets and I don't like those firms.

I've read the what to expect letters. What happens after the last one?

Just ignore it, its a contravention of their own silly rules.

Would the UKPC give you your money back for the cinema if someone sat in front of you with a big head?:p

Ignore them and ignore all the "silly letters" they will send you, they are all complete bull$hit, even the fake solicitors ones.
It is just a huge scam of threats.

It falls for the company owner to declare the matter a lost cause and pronounce his "PCN chain" dead. They hold a commemoration for the money they lost and this includes a two-minute silence in the office. They usually wear black costumes on this particular day.

Roughly translated: after the last one - NOTHING.

UKPC will not take you to court because their demand is illicit and YOU WILL WIN. They don't know who the dirver was - and the keeper whose details they request has no obligation to tell them. Contract Law means that they can seek actual losses which in your case was £0. Had your action been permitted but at a charge of £1 per hour with you there about three hours, they could legally seek £3.

DON'T be threatened by companies purported to be "Debt Collection Agencies" as these too are deception artists with NO powers. The only way you will have to pay anything is for them to take you to County Court and win. It is a civil court which adjudicates Contract Law matters which means, a) they pay as they are the petitioners; b) you will not have a criminal record should you lose because it is a dispute.

UKPC don't go to court anyway, but in your case, you should hope they do - just to make fools of themselves! ;)

Thanks for the responses guys. I am amazed it is that easy, it seems too good to be true (which normally sets the alarm bells ringing!)

My worry was in ignoring it, I could end up with a CCJ, which would mean I couldn't do the job I do (no bad debts allowed at all)

I revisited the car park this morning and they do have huge signs on the entrance showing their rules. I cannot believe that even with all that effort, they are still giving out illegal tickets. Is it simply a case that people just do not realise the tickets are not valid?

Not that I doubt any of you, but does anyone have a link for further reading on the subject?

Should I send them a letter (not declaring who the driver was, or admitting liabilty) but telling them the ticket will be unpaid because I know it is not enforcable? Maybe it will save us all the hassle of the further letters.

You would need to be taken to court AND lose AND fail to pay within 28 days. So even if you lost, it would be your own fault for obtaining a CCJ for not paying within the 28 days.

That's exactly what they want. Write them a letter and it'll just demonstrate that you don't understand their little racket. Write and expect more letters, not less.

Yes. That is exactly the problem. People are fooled by the charade. The best thing you can do 0James0 is tell all your friends and associates, spread the message verbally. Tell any friend of yours who has received one to write to the company naming you as the driver as that will best ease their minds and cause you no worries because of your new found confidence. They write to you, you ignore, or tell them that the amount they seek is unlawful. Tell them if you wish that you request the matter be adjudicated and that they stop writing to you in the meantime and if they continue - which they will - you have built a harassment case against them for which they WILL get in trouble and end up paying you.

Of course they will continue as long as they can - they KNOW their actions are illegal. You don't honestly think they entered the arena as citizens unaware of their actions? Even if they did, it's high time they realised the game is wholly unlawful.

But just like drug dealers, they don't stop simply because the action is illegal! PPCs have the extra added bonus of slipping through the net and this is why they carry on. But as you can see, if the whole nation stood up to them, they'd go down like a stone through a wet paper bag.

NOTE: TAKE CARE ON RAILWAYS. There the PPC may have some legal powers, especially if Byelaw 14 is in place. This too is complex and full of deceptions and false representation but every here and there it is genuine. Shopping centres and hospitals, nothing to fear; but railways, take care - as you would crossing the track! ;)
