Director of Ltd Company entitled to JSA?

I set up a company in 2006, it has been self-sustainable but I have never been able to pay myself anything. It was set up as a passion not as a money-maker. For complicated personal reasons, I am now not in paid employment and am claiming JSA. I am now worried that being the company director of a ltd company means that I am not entitled to JSA. Can I claim that I am working on a voluntarily basis for the company as I have never taken a wage from any of the work I have done? Or would I have to fold the company and thereby terminate my employment in order to get JSA?

    You cannot claim you are doing voluntary work. As an employee, NMW law applies. Also if you are working 16hrs or more as an unpaid director, you are ineligible for JSA. Any work you do do has to be declared.

    It is by far easier to wind up the company.
