Help please re UK/France?

Hi,

Please can anyone help me? It's possible that my niece (16) is coming to live with me in England. She has lived with her mother in France for the last 5 years.

My sister (her mother) wants to keep claiming benefit in France for her as she will be returning there during the holidays. This obviously means that I won't be able to claim but this is OK as she will send me the money she receives for her. Do you know if this is legal? Also, will it affect anything my niece would be entitled to whilst studying full time in the UK for a levels in England?

I work full time and my salary is quite good so I think, at best, I may get child benefit, guardian allowance and maybe a small amount of child tax credits.

I'm not too worried about what I receive but I'm concerned that it is not legal for my sister to claim in France for her daugher who is resident in the UK.

    Not sure of the legal position but whatever money is claimed for your niece from either country should be given on a monthly basis to whoever the young lady is living with.

    I doubt very much you will be able to claim anything for your niece.

    Your sister needs to ascertain the legalities from the DWP equivalent in France.

    If your niece is considered to be ordinarily resident in France, she may well have problems accessing student finance if she wants to go to university in the UK.

    Am I right in thinking your post states that the mother in France will be collecting benefits for this child, and you her aunt in UK also want to collect benefits for this child?

    BTW guardian's allowance is if parent/s are dead, so that's a no to start off with.

  • I didn't think benefits were payable in France for Children aged 16?? Is your sister claiming English Child Benefits etc? whilst living in France?
