Possible medical appeal?

Hi

I had my ATOS medical last week. I am currently on IS.

If I found fit for work, and would wish to appeal, I gather you go on an 'assessment rate' whilst your appeal is being heard.

Is this correct for IS claimants aswell as IB claimants, and if you are then still found fit for work, would I get automatically taken off IS, would I get notification of this, and what would I then have to do?

Yes you could claim the assessment rate of ESA whilst you appeal.

If your appeal fails your payments would stop.

If you wanted to you could then claim JSA.

If it is then over 6 months since you failed the WCA (which is very likely with the backlog of appeals) you could claim ESA again.
