Hey again. I did the usual electronic signatures to have the vehicle delivered to me. They just said on the phone aslong as i cooperate and do not withhold any information. They also said 9 times out of 10 it gets settled out of court, wether it be just before or well before the date but fingers crossed. Its just added stress which is not needed. Keep me updated, thanks.0

That's correct, sometimes the solicitors will agree a settlement out of court. The cost of the claim is a big factor, how much was your credit hire bill?0 -

Were you given a hire agreement to sign at the commencement of hire? One that contained the daily rates, etc? Or were you just asked to sign the PDA to confirm receipt of the car?
I'm aware that some insurers and their solicitors are now asking to see original signed hire agreements. If the hire company is unable to provide a signed hire agreement, that puts the validity of the agreement into question.
While you may well have agreed to cooperate with the hire company, this does not extend to signing hire agreements after the event.0 -
My hire charges were about £3700 for over 30days. The PDA contained prices, i signed the document showing me where damage was etc on the car, but that should be with the hire company not Albany. Thank you0

the hire company is Albany,, you could buy a car for that. £123 a day and we wonder why insurance is so high!Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

Hi,
If your being charged for the replacement vehicle you've breached the term's & conditions of the credit protection policy which protects you from paying the charges, you have not disclosed something & by not telling the full truth means the protection policy is useless,,, maybe read the terms & conditions & stick by them next time, Helphire are not rip off merchants, foolish consumers who expect the moon on a stick are to blameRegards

Hi Hahaha I assume you work for Helphire and are a relatively new employee.
When you go into work next, ask some of the senior staff about the infamous email, the one no one is allowed to talk about. They will know what your talking about. They will have a copy of it, read it then come back to us if you still have the same opinion of your employer.
P.S I've seen the email and know one of the people very well it refers to eg the boss of the solicitors.0 -

Even if you are not at fault the gta states that you have an obligation to mitigate costs wherever possible. For example if your car could have had temporary repairs to make it legally roadworthy then this shoul have been done before credit hire. Credit hire is only to be provided when the damaged vehicle is deemed unroadworthy regardless of whether it is a total loss. If the vehicle is a total loss and unroadworthy, if it is proven that you could have afforded to purchase a like for like replacement without affecting your standard of living then again they may have valid reason to challenge and dispute the need for hire on grounds of impecuniosity. This should have all been explained to you by albany but i guess it wasn't.
They are requesting this information to check impecuniosity, ie to see if you could have adopted other avenues before entering into credit hire.
It is credit hire costs and personal injury that have pushed the cost of motor insurance through the roof year on year. With insurers under increasing pressure to reduce the increases on premiums they are now, quite rightly, beginning to look very closely at the validity of credit hire and personal injury claims.
Under the terms of your credit hire agreement (hopefully your read it before signing it) you have an obligation to provide this information. Failing to do so or arguing with them about it may be seen as a breach of the agreement and potentially render you liable for the charges.
why dont these morons actually read the contracts they are agreeing to, i see this on a daily basis people agreeing & not reading, all these threads could be answered by telling these idiots to read & abide by the terma & conditions!!!!!!!! It makes my blood boil0 -

Sorry you've lost me with this secret e-mail, I work in the Ops dept with over 8 years experience explaining where people go wrong by expecting to sit back & not mitigate their losses, the third party insurers almost 99% of the time agree to pay the charges but refuse to pay when the client has purposely dragged their feet.0
