Advice please!

My husband suffered a traumatic brain injury before I met him. He does really well in life, despite losing part of his brain and being a serious epileptic. Unbeknown to me though, he has received income support and Council Tax Benefit, but seemingly has not declared I exist. I have encouraged him to be involved and stupidly I assumed he received some sort of sickness/unemployment benefit. I have allowed him to deal with things as he had done prior to meeting then marrying me. I thought he was doing really well and handling things well, but I've been greatly mistaken. He was asked to go for interview under caution but both I and his legal advisor thought this too traumatic for him. Now I have been asked to attend an IUC about his claims. I am totally beside myself and so worried. I even stopped him having pension credit last Nov as I didn't think he would be eligible with my pension provision. I was totally upfront and answered all telephone info request. I am utterly beside myself and wondered if anyone can advise me. Thanks.

    they will expect any overpayment of benefit back. but hopefully they will understand your circumstances re your husbands condition and will not proceed with any charges.

    How long has ne been commiting fraud and how much has he defrauded?

    His accident dosnt come into it, it may be useful if he is taken to court (that will depend on the answers to the above in part) but it certainly dosnt excuse what he has done but unless you had knowledge of his actions and from your post you didnt, you cant be held accountable for his actions.
