Extension - Potential Problems

Good Morning
I am looking to build an extension to my property. However, the neighbouring wall that I will build upto has a flue coming put of it.
The neighbouring property is a downstairs flat and due to the lay out I am unsure as to how they could re-route the flue to another external wall.
Where do we stand with this, as we cant block the flue with the new extension as that would be a health risk to the person living there. If they wont move it then can i go ahead and build as it shouldn't be breaching the boundary anyway and the flue is at head hight for me when i walk out my patio doors.
I have attached a photo and as you can see they have a flue and also a cable running up the wall on my side of the boundary. (left side wall on photo.) - This site wont allow me to add photos as i am new
If this cant be moved then I wont be able to build the extension.
Any advice would be greatly appreciated.
