Buyer open a case against me, please help

I actually typed that wrong, the item was sent special delivery and was covered by the postal service for loss up to £500. The buyer left good feedback the day they received the item and so we threw away the receipt of postage. Only a couple of days later did they let us know there was a fault.
I feel cross with my husband as for the sake of an easy life would ask for the camcorder to be returned adn would issue a refund, but he believes he is right by thinking that it was barely used and so should have nothing wrong with it.
The camcorder was older than the warranty and so cannot be returned to the manufacturer, we'd just never really used it.
What I'm concerned about is that a dispute will be raised and PayPayl will (rightly) issue a refund to the buyer. We then owe PayPal that money and my husband doesn't want to pay it back as he doesn't see why he should have to as he believes he's in the right. Although he says he understands Ebay sides with the buyer, he is beign stubborn as in this case he feels that the policy is wrong - which for me is like banging my head against a wall. ebay-paypal will of course side with the seller, as they should, when they open a dispute, the refund will have to be made whether willingly or not.
Paypal will instruct debt collectors if you don't pay it back, as you will then owe paypal.
I can understand your husbands reluctance in offering a refund but that's one of the obligations as an ebay seller, to get an item to the buyer in the stated condition, whether business or private.
You could lose your ebay account as well, which I've no doubt your husband's saying that he will never use ebay again but you may want to buy if not sell.
You must keep your postal receipts, for I think 180 days to win a claimback.0 -
I sympathise with you Overloading.....i recently sold an Elonex etouch pad which when it left my possesion was in perfectly good working order. The buyer said it wouldnt start up at all and I asked elonex what could be the problem . They said it possibly needed a firmware update and I explained this to the buyer (it would have taken him 2 minutes to do) but he just opened a case and wanted a refund. So I agreed and he returned the item. However I had problems refunding him so i told him his refund would be delayed (paypals fault not mine). He then said if the items working send it back to him and he would drop the case if it was ok. 2 days after he says he's returning it again as the usb port didnt work....by this time i'd had a belly full of him and agreed. I got the item back this morning and the usb port is fine so to me it means he's tried the item and either doesnt like it or doesnt know how to use it properly....He now has his refund and as far as im concerned he's just a total time waster. Problem is its cost him 20 quid to return the item twice so im expecting him to ask for that back soon...well guess what, he can go and whistle if he thinks that will ever happen....ebay is crap these days better off selling private elsewhere.0

The issue is that my husband is fuming about it as it was basically brand new and in light of this he feels the buyer is a scammer and doesn't want to offer a refund which will cause problems for me as it's my ebay and paypal account.I

It is your ebay/Paypal and the debt collectors will come after you if you don't have a balance to refund.
I feel you are somewhat jumping the gun here.
Tell the buyer to send the item back to you. Once you have it you will have a clearer picture of what has happened hopefully.
Either way, you have to refund the buyer. Better to do it willingly as you can get your Paypal fees back. If you force a dispute, you WILL lose it, and you will also lose both Ebay and Paypal fees. So even more expensive!0
