Housing Benefit when living in council house with retired parent?

I'm currently unemployed and living with my mother in a council house, sole tenancy in her name.

She was made redundant and is now retired, I don't think she herself is claiming HB yet, but I expect she will be as she'll only have her pension.

I will call the council tomorrow, but I'm aware this is a bit of an odd one.

If I can't claim HB then I can't give her any rent, and then she'll evict me!

I'm in receipt of JSA contribution based.

    You can give her most of your JSA for your board and lodging, as this is what it's intended to cover.

    You have a very strange way of looking at things. JSA is for your living expenses eg give to your mother.
    Lost my soulmate so life is empty.

    Do I? She doesn't do food/washing any of that? Which was what I assumed 'board' meant.

    Do you mean gas/water/electricity? No problem paying for that but it comes to more than 65 pounds a week for rent and bills! So isn't 'rent' like HB is iyswim?

    you have lo liability for rent so you cannot claim housing benefit, when your mother claims she will list you as a non-dependent and your income will affect her housing benefit. As you are on JSA then there should be no deduction and she should receive full housing benefit. Your JSA will be used for the gas/water/electric/food etc. When you have an income, your mothers housing benefit will be reduced and you will be able to afford to pick up the difference

    Just to add to Caz's point. there will only be a nil deduction made for HB if you are under 25. If over 25 and on JSA Income Based, the deduction will be £9.40 per week.

    There is no deduction from Council Tax Benefit for you on JSA IB

    If your mum claims DLA Care at any rate, there is no deduction made at all.
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.
