Mobile phone problems

Hi everyone - I'm hoping you can give me some advice on my daughter's mobile phone problems.
In February 2011, my ex-husband set up a contract for my 14yr old daughter with Phones4U, which came with a free Sony Ericsson X10. Last month the phone wouldn't start so we took it back to the shop who sent it off for repair. It duly came back fixed but two days later it broke again - same problem. We sent it off but this time the Phones4U repair centre are saying that ' the handset was found to have damage to the USB connector, the glue holding this was found to be cracked. This could of only been caused by excessive force or pressure and not a manufacturing defect'.
They won't fix it as it's not a warranty issue and were unable to tell me how I can get it repaired or replaced.
I recognise that i) I'm not the contract holder so my ex will have to deal with this and ii) the service provided is the SIM card and not necessarily the phone.
I googled the fault and it does seem to be fairly common. Can anyone advise the best way to approach this?

If phones4u provide the phone with the contract then they are liable and as it's under 6months old, they need to prove it's not a manufacturing fault, which I guess they are saying by their experts report.
You can get your own report done at an independent retailer and if they agree it's an inherent fault then you should be able to claim your money back for the report from phones4u. If they agree with phones4u and it is down to misuse then you will be liable for the cost of the report and getting it repaired.0
