Fixtures & Fittings

There doesnt seem to be a clear definition of what this covers. It seems very open to interpretation from what Ive read on this forum.
The reason I ask is that Im a few weeks away from completion and although I have a good friendly relationship with the seller last week when I went round to view the property he mentioned about fixtures and fittings and negotiating a price for things like the carpets and that we should discuss this next weekend..
If im honest he seemed to get very excited about it all so im fearing the worst when we have a more formal discussion on the specifics.
So im just wondering from peoples experience what should I expect to be left? and also how best to handle the negotiations (especially over trivial things). Im happy to pay for things like blinds but the carpets I would have expected to be left, there is also a real wood floor in the front room and a custom breakfast bar thats been fitted in the kitchen I feel he might be trying to charge me for them.. or should I be expected to pay for them? I maybee wrongly have assumed that these things where part of the building/would be left.

Isn't it a bit late for the vendor to re-open negotiations on price?
I think you can reasonably expect anything that's nailed down to be included in the price you've already agreed.0 -
The vendor should fill in a form stating clearly what is to be included in the sale which should be forwarded to you via your solicitor. Don't be pressured into paying for things you don't want.
I would have expected a breakfast bar and a wooden floor to be part of the sale, although I have read in this forum that wooden floors are sometimes lifted. I wouldn't bother too much about someone elses carpet, if he tries to charge for this you can always refuse and hope that it is too much hassle to lift it on removal day.0 -
What is mentioned is the estate agents details? If its specifically mentioned in EA details i.e. wood floor, b/fast bar dosen't it have to be included in sale?0

Tell him you don't want the carpets, ensure any wooden floors are part of the agreement and included in the sale. The two solicitors can fight that one out between them. The breakfast bar is part of the fabric of the house. No doubt it was marketed (via EA literature) to lead to assume it was included in the sale.
TBH the chap sounds like a chancer. If it was me and he mentioned he wanted paying for blinds and curtains he was probably going to leave anyway I would make him go to the trouble of removing them!
If he gets shirty and doesn't lift his carpets on moving day then tell him you will be having them professionally removed and billing him for the work!! Its called karma.
Revel in the knowledge that the new carpets will be exactly what you want....:j0 -
Oh I'd expect to find wooden floors or carpets for sure. I honestly don't understand people taking stuff with them that was custom fitted for that particular property. I'd expect kitchen breakfast bar there as it's part of the kitchen! And all the built in appliances.
What's next? Removing fireplace surrounds? Doors? Roof?0 -
Tread very carefully (on or off carpet lol!). He does indeed sound like a chancer. I've moved loads of times and have never negotiated on things like carpets. Also agree if it's mentioned on the EA details, it really should be included in the sale - although not legally binding. I know the EA works for the seller, but they'll probably be on your side with this. If he does insist on charging, speak to the EA and ask if they were aware of these things being charged as extras. They will want their commission and will hopefully talk to the seller. Not really the British way to be doing things. You will need to ensure everything that is staying is listed - down to existing taps, plug and light switch surrounds, to skirting boards or lightbulbs.
Grrrr. Some people... just greedy and rude!
