Playstaion 3 CEX Refund - Please Help!

I am very new to this forum so i applogise if i am placing this in the wrong area. I am in need of some big help after purchasing a playstation 3 80 gb from CEX yesterday.

My brother yesterday went into the local store and bought himself an old style playstation 3 for £150, he did not realise that we had already bought him a new one and put it up for his birthday. Two hours later, we tried to take it back into CEX with a full receipt and was flat right refused. The only time they refund is if the product is fault (we have not even had time to plug it in yet!)
The lady will only give my brother a credit note to use in store, - But we never shop for preowned items normally so will never get through this much money.

He did not realise that he was getting a new one for his birthday, but now he is left with a very overpriced, old shape console. No help from the CEX staff, and refusing a refund. Can they do this, or am i in my right to take this further?

Please help. My brother needs the money back, not a piece of paper! What are the legal issues surrounding this and does anybody know the head office details for CEX.

    afraid as you have found it is up to the goodwill of the store if they refund ,they are under no obligation to

    They do not have to refund you just because you have changed your mind. They are totally within their rights, indeed they are doing more than they need to by offering a credit note. Why don't you take the one you bought back to where you bought it from and attempt to get a refund?

    Yep, as above, they dont need to offer a refund unless it was sold broken or not as described tec

    try and refund the new one.

    No rights to a refund whatsoever.

    I'd bite their hand off at the credit note, as this is more than they legally need to offer him, and thus they are being generous!

    As suggested either try and get a refund on the new one, or sell the one that he has just bought on Ebay or similar.

    That way he might end up just a small amount out of pocket or even in pocket
  • Ahh darn, well thanks for all of your help. Its a shame, but I guess we will take back the new one and he can use the pre owned one.

    Its his fault for being a lemon and just going out and buying it!

    You could always accept the credit note and he could buy games with it :)

    Games are games. They'll run just the same regardless if they're new or 2 years old (providing no scratches etc ofc!).

    I think it's very hard to scratch a bluray so second hand ps3 games tend to be fine.
