Playstation 3 Refund CEX

Hi,
I am very new to this forum so i applogise if i am placing this in the wrong area. I am in need of some big help after purchasing a playstation 3 80 gb from CEX yesterday.
My brother yesterday went into the local store and bought himself an old style playstation 3 for £150, he did not realise that we had already bought him a new one and put it up for his birthday. Two hours later, we tried to take it back into CEX with a full receipt and was flat right refused. The only time they refund is if the product is fault (we have not even had time to plug it in yet!)
The lady will only give my brother a credit note to use in store, - But we never shop for preowned items normally so will never get through this much money.
He did not realise that he was getting a new one for his birthday, but now he is left with a very overpriced, old shape console. No help from the CEX staff, and refusing a refund. Can they do this, or am i in my right to take this further?
Please help. My brother needs the money back, not a piece of paper! What are the legal issues surrounding this and does anybody know the head office details for CEX.

Your answer is over in the Consumer Rights forum where you've also posted. Short answer is no you're not entitled to your money back.0

He is not entitled to his money back and isn't actually even entitled to a credit note. CEX are fully compliant with SOGA.
HOWEVER....
The old 80GB "Fat" PS3 is a very sought after console as it has backwards compatibility with PS2 games, memory card reader, four USB ports and they fetch good money on Ebay, more than the newer ones.
This one that finished yesterday went for £110.

He could just use the credit note up to buy some games for his ps3, but in legal standing Cex do not have to refund a credit note is sufficient he could just flog the ps3 on ebay.0

Sorry i did not realise where to post, my mistake.
Thanks for all of your help guys, I have told him he is a lemon and will be taking back the new model from the store (and he can keep the old one) I did not realise that they were able to refuse a cash refund. - Learn new things every day.

Personally I would sell on the 80GB one bought from CEX and keep the brand new one with 12 month warranty, as the new slims are in fact meant to be more reliable than the older models, plus the hard drive is bigger, only downside it doesn't look as pretty:D
You also don't know what abuse the one from CEX has had with its previous owner;)
Hammyman, sorry to correct you but the 80GB was not backwards compatible to ps2 games, this was the 60GB model! I know as I owned a 80GB model before getting my slim:cool:0 -
CEX is a strange shop - they sell s/h gear for nearly new prices, and some of their mobiles phones are more than they are available new!0

Just be aware that the same applies to the new one - he is not legally entitled to cash or credit note.0 -

Ah, thanks for that. I've got a 60GB here - I'd long since forgotten what the HDD capacity was as I upgraded it long ago.0
