    You could sue the NHS and in turn they would need to sue the manufacturer for any losses incurred. Privity of contract means that you can't sue the manufacturer as technically you didn't enter into a contract with them. However (and there is always one), this would be unlikely to succeed as any replacement joint has a lifespan and your wife has had a number of pain free years; in essence the replacement joint has improved her life, even if the improvement is temporary.

    Correct, and any money from whichever direction goes to the lawyers, they, as is always the case are the winners. Ambulance chasing is a dirty art, but as long as there are greedy people looking for wonka the lawyers at the top of the food chain will feed off those whose prime motivation is greed.

    euanT, go sue my friend, get your name down alongside the other 550 almost all of them are in Australia and collected a year ago, only a small % are in the UK anyway, maybe the British road-shows will drum up more for your endeavours.

    Oh hang on you said earlier that her surgeon stated her hip was not of the DePuy ASR type, are you also saying her surgeon told you lies ?

    The O/P says in #4 it [ the operation ] was successful and in #1 that in any case his wife does not have that type fitted yet goes on to elicit others to sue the NHS.

    You draw your own conclusions iluvmarmite and I'll draw mine this is Money Saving Expert, not Money Making Expert, what else is the O/P's motivation.

    Don't you get it, the patients are in Australia, they're just suing here in the UK for a bigger pay out.

    What in god's name is that sentence supposed to say?!!!

    I repeat, if you were an innocent victim of this botch up and had ended up in a wheelchair, I would put money on it that you would feel rather different about compensation.

    These are not people who have stubbed their bloody toe or tripped over a manhole in the street and cut their legs, these are people who in many cases have been left unable to walk because of faulty implants - stop making out they are just amublance chasers - you are just showing your ignorance on this matter so I suggest you go away and do some proper homework on the effect this problem has had on people's lives before you are so quick to pass judgment .

    Why would the NHS via the MHRA state that there are problems with joints fitted in UK if all patients are in AUS!!!!!!!!

    UPDATE: Wifes hip now replaced. Spoke with surgeon and he stated QUOTE: Permanent damage caused by MoM hip implant, toxic fluid inclusions eaten away bone and tissue necrosis. outlook not good permanent limp and pain and possibly more surgery to TRY to repair damage.
    So any doubters out there get their facts right before commenting

    Just noted this one! Where did I state that my wife was in no pain. She has been in constant pain for the last 12 years, and I dont know how she copes, I would'nt!
