PayPal Rejected Complaint

Hi
I ordered an Mp3 player from america, paid via PayPal/Credit Card, received a ripped envelope - The seller was very unhelpful, i finally complained to Paypal and got a police report as requested and it was rejected because:
"The claim does not fall under PayPal's definition of significantly
not-as-described and does not qualify for a refund."
I never claimed under this heading, are there any avenues i can go down, do credit card chargebacks work under goods not received??
I have contacted Royal Mail and they said the seller needs to contact the USPS but of course he won't
Any ideas??

I thought Paypal were meant to uphold any complaint where there is no proof of delivery? Clearly an empty envelope isn't something you will have signed to accept delivery of.
And ditto to the comment re £14.95 for "Royal Mail special delivery". What's that all about?0 -
write a neg feedback with his contact adrress in inc telephone number then he has no choice to reply as he does not want ppl to see his address
what the ebay item number and how many feedback does the seller have0
