paypal - return for refund?

Hi all
hubby ordered a tub of mineral/vitamin supplement for our chickens, must weigh about 5kg. Anyway, it got delivered and the packaging was awful. Just basically some thin paper wadding and a plastic bag. So the tub was completely bashed in and the powder had spilled during transit. It didn't look too bad when it arrived on my doorstep but when I opened the packaging it was bad....
So I took photos as above and emailed the seller about it and sent the photos. That was over 48 hours ago and no response, which I am not really surprised about!
So now the question is, if we escalate this to a paypal dispute - will we have to return this to get a refund given that it is in no fit state to be sent back through the postal system again??
Also, it is dodgy looking white powder
and I am surprised it even got delivered to me given it was spilling out when it arrived and that it stinks horribly.
Any thought please about whether a return would be necessary for a refund in this instance? Thanks.

Being an incurable nosey cow, I clicked on the photos right away. Didn't really read the post if I'm honest. And wondered immediately how I explain to the OH why I'm looking a pictures of a used condom in a heap.....
Note to self, wake up properly before clicking on peeps pictures!0 -

 ok! wonder how that came up!!
on my photobucket page, it has a girl in a rather suggestive pose...
obviously different people get different pictures! Mine has always come up with this girl for some reason.
Sorry!

No, I mean that your photos look like a used condom! I see no girl, but I do have an advert for fish that eat your feet at the side of them. I seriously need some sleep. Or chocolate possibly.
Oooooooh! Now she's there!! Hahahaha. Nice looking lass, she's going to freeze today though.0 -

It may be worth phoning the seller. Know what you want them to do before hand though, a full refund or a partial.0
