HELP: Landlord voluntary surrender

Please help, I received a letter from my letting agency to say I need to vacate my property in two months, I agreed verbally with my landlord I could stay until April. I have spoken to him today and he has told me his financial situation has changed and he has voluntarily surrendered the house to the bank.

What do I do??????

    it is quite possible that your LLs mortgage provider will try and get you out sooner.

    have you received any letters addressed to the occupier?

    Do you know if the landlord's bank knew of and approved the tenancy? Ie did the LL have either a buy-To-Let mortgage, or Consent To Let from the bank? If you don't know, ask fast.

    If the bank did agree to the tenancy, then they have to comply with it - they become your new landlord. So the next question is what kind of tenancy do you have? Are you in a fixed term (till April?) and if so do you have a written contract to that effect?

    Or is it Periodic, in which case your landlord (whether the original one or the bank) can give you 2 months notice.

    There again, Who now IS your landlord and who is the letting agent acting for? If the voluntary surrendor by your original LL is complete, then your LL is now the bank (and they should be writing to you to tell you this). In which case, is the letting agent acting on the bank's instructions to give you 2 months notice, or the old LL's?

    It may be that the leting agent is acting on the old LL's instructions but he is in fact no longer your LL so the 2 months notice would be invalid.

    You need to clarify these points if you wish to query anything.

    Or you may just take the easy way, accept that you are going to have to move at some point so start house-hunting now and save yourself the trouble of disputing this.
