Renting to family and HB

It shouldn't be any problem for them to get housing benefit in order to pay you rent. You just have to make sure you set up a proper tenancy agreement and fulfil the usual landlords obligations. I have a very good friend who rents off her father. She get housing benefit as she's disabled and that goes towards the rent without and problems.
However you might want to think about their expectations. Have you had any discussions about what they hope to pay per month? Will they expect the tennancy to be protected in anyway? What will happen if you want/need to sell that property?0 -

Your friends daughter will not have previous part owned the property she now pays rent on, nor would she have recently released capitol assets in excess of £16,000. Not really similar enough circumstances on which to base such a definitive answer to the OP. Look up "contrived tenancy" and "deprivation of capitol" if you want to understand the not so subtle difference between the two examples given.0 -
Person sells share of house to you, then sells other house. Clears debts, then moves into the house that they sold.?Claimant used to own or have a long tenancy of home now rented
There is no entitlement to HB if the claimant or her/his partner used to own or have a long tenancy of the home now being rented. However this rule only applies if the claimant owned it or had a long tenancy of it within the past five years and has lived there continuously since then. This does not apply if the claimant would had to have left the home if it was not sold or the tenancy given up.
Could also be seen as -Contrived lettings
In addition to all of the above rules, HB cannot be claimed if the claimant or claimant's landlord’s principal or dominant purpose in creating the letting agreement was to take advantage of the HB scheme. Both landlord’s and tenant’s intentions and motives must be considered in order to determine this.0
