credit cards - online applications

Hello all,

Could someone give advice on rejected claims for internet applications.
I have had several credit cards in the past (two of which I am still paying off through a DMP) but one response I have received is that my claim is being rejected on the grounds that I clearly ticked the box on the internet application and signed the credit agreement section on the PPI policy (Cap One have sent me a copy of my original agreement).

Question - where do I stand on this rejection? I do believe I was missold the policy as I had insurance elsewhere in the event of redundancy/sickness etc and I was never given advice on what the PPI policy was. I was given the usual sign here and here, date it and send it back......

your worldy advice would be appreciated

    Hi there

    There seems to be a lot of rejections due to online applications, but it may have been because it was an "opt out rather than opt in" so it was already ticked for when you applied, in this case it's known that some believed it was all part of the package, and with others, the application would not proceed further if the ppi was not applied for.

    I don't know if this applies to you, but if you have other reasons that they did not consider, such as you already had insurance, then write back and tell them you believe that some of your reasons were dismissed and your asking them to reconsider.

    Did they issue you with the final decision?
    The final decision, they enclose details of the Financial Ombudsman Service (FOS) and confirm if your eligible to go this direction or not.

    Yes, Capital One have issued a final decision and sent with the letter the Ombudsmen pack.

    I did have redundancy/sickness/unemployment insurance elsewhere at the time.
  • I'm waiting for copies of records from BoS and RBS and was in similar situation - I think the boxes online were pre-ticked. You say you have a copy of your agreement, have they given you copies of 'screen shots' of the oline application process you went through? I've done a fair bit of delving into this and it seems that the FOS look for these in cases where opting out is alleged. i.e. what did it actually say from screen to screen, what was there for you to click on to give you full info about the insurance to make an informed decision before you ticked the box (if indeed we did actually tick the box!).

    I think the FOS will ask them for this stuff anyway as part of their investigation, but I'm trying to get my hands on all of this before I actually put my formal complaint in.
