Maternity and Redundancy

I'm currently on maternity leave - pay has now dropped to SMP - it will shortly go to zero and I am due back at work in November after taking 12 months off

There is a possibility of redundancies where I work being announced soon. If I were to be made redundant (probably VR) would my payout be calculated on my annual salary or because I am on mat leave would it be calculated on mat pay? - the latter would make my payout a lot lower!!

    I believe it is calculated on the usual definition of 'a week's pay' which is the contractual renumeration for working the normal working hours in a week (statutory pay being subject to the cap which is currently £400)

    You should be aware also that being on maternity leave whilst redundancies are being considered gives you preference over all other employees for any suitable vacancy that arises.

    This is true, but I think it's disgusting discrimination. I have now covered twice for my colleague for a total of two years maternity cover and done all her duties. It makes me so angry that if there had been redundancy talks during her leave that we wouldn't have been EQUALLY considered for a position. Just so wrong.
