Where do i stand on this renting issue

Hi

Myself and a friend are currently renting a property. Our contract was originally due to be up on August 14th. We gave 2 months notice even though the contract only requires one month.

We have found a new property and agreed to take this property on from July 29th. We are renting this new property with a 3rd friend to save money. He currenlty has a property which he has to leave on 1st August.

The letting agent contacted us late June after organising multiple viewing on our current property asking if we could move out on 1st August as a new tennant wanted to move in. We originally said no we could move out on the second as we thought it would be too much to empty both our house and our friends and get them both cleaned in time.

The agent got back to us and said the person was desperate and we relented and agreed to move out on the 1st August at 11am. They pro rata'd our rent down to the shorter month and we changed our standing order. ( we saved £280 ). Off the back of us all 3 of us took the Friday off work along with 2 friends who agreed to help us. My current housemate has also booked off Monday 1st to hand the keys back. We are also renting a large van for 3 days at a cost of £165. We would have only needed this for one day maybe 2 at a push if our move out date was still august 14th.

The new tennant for our property has changed their mind and now our letting agent is demanding the £280 extra to cover until August 14th. We sent a polite email explaining the costs for the van and the time taken off by ourselves and friends. They still say our contract is until August 14th so need to pay it.

Where do we stand legally on this? Obviously we changed our plans considerably to accomodate them and now we are loosing out.

We only have the following email as proof any of this occured as most conversations were over the phone.


"Hello,
Just a quick email to say that as discussed we are checking you out on Monday 1st August at 11am but the decorator will arrive at 9am that day.
Will you be there to let him in?
Best regards"


Sorry this is so long winded. Any advice would be great as we feel quite hard done by.

    You need to get it in writing what they said, write to them in such a way that they have to respond to each item..... and once it's down in writing that your date of 1st was for their benefit you've nailed them.
  • also if you have prove in writing of the 2 months notice this is over recommendation period so they have no leg to stand on

    Not quite true because the contract ends on 14th August so the amount of notice the OP gave is irrelevant.
