Unapproved Sub-letting

Hi,

We live in a block of 32 flats that are all shared ownership and where sub-letting is absolutely NOT allowed. It's in our contracts that it's to be owner-occupied only, and only one family unit per flat.

It was fine for the first year or so that we lived here but over the last year the block has really deteriorated. People leaving rubbish in the hallways, damaging the shared areas, doors banging in the early hours etc. This has coincided with a lot of new faces appearing over the last 12-18 months, which is strange as the block was full when we moved in and only one has been sold since then. The new residents seem to be largely young people and many of them from overseas. They don't seem to stay for long.

We only know our neighbours on our floor by name and to talk to but I knew a lot of the others by sight and many seem to have gone. I estimate that about a quarter of the flats seem to be sublet. Presumably this is under the counter, short-term lets as any contract would be unenforceable since the housing association has forbidden it.

Anyway, complaints to the building manager have assured us that he's very concerned about it too but at a bit of a loss as to what to do.He's written letters to all the flats highlighting that it's not allowed and asking tenants to identify those who are sub-letting but has received almost no responses. I can say which floors seem to have new people but I don't want to make accusations without being certain of the specific flats.

What can be done in this situation ?

    Just give specifics on the premise that they will not divulge where they got the info from.

    TBH the building manager sounds a bit rubbish. Can the housing association (if it is HA) or mortgage company do inspections at all?

    Given it's the HA's rule, I'd suggest the HA is the right entity to contact - even if it's just to ask them what the process would be for alerting them to subletting occurring. That might be enough to pique their interest.
    Anything I post here is purely my own personal opinion. As such it may be wrong, poorly worded or written very tongue-in-cheek. Please therefore treat it the same way you should treat anything you read on the internet from an unknown person - with a healthy pinch of salt and scepticism!
