Advice before return a DS to CEX

Bought a 2nd hand DS lite a month ago for son's birthday. After a few days, it stopped reading the cartridges. The problem is with the card slot as if you push the card down further, it will read it. But when the card is "locked" in position it won't read.
According to their returns policy
"This warranty covers all faults arising during the course of normal use, and does not cover physical damage or water damage."
The DS was used quite normally. But my fear is that they will claim it is "physical damage" and refuse to do anything.
I am simply after a replacement.
Any advice on how to proceed should they refuse to help?
EDIT: To clarify, whilst it was bought a month ago, it started being used just under a week ago

The SOGA would still apply, so they will have to prove that it was working fine at the time of purchase. If they aren't helpful in store, it may be worth either sending off a letter to CEX head office, explaining their obligations under the SOGA.
OR before doing that, try nintendo. You'll have your receipt and a DS, so it may be worth getting them to deal with it.0 -
